DECISION & ORDER ON MOTION

Motion by the respondent Hartford Insurance Company to strike the appellants' appendix on an appeal from a judgment of the Supreme Court, Queens County, dated February 4, 2013, as inadequate. Application by the respondents Peter M. Redmond, Matthew M. Lupoli, and Peter M. Redmond, P.C., inter alia, to correct the designation of the parties contained in the Request for Appellate Division Intervention and to direct the appellants to correct the appendix. Application by the respondents Peter M. Redmond, Matthew M. Lupoli, and Peter M. Redmond, P.C., pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief. Application by the appellants pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a reply brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the applications and no papers having been filed in opposition or in relation thereto, it is

ORDERED that motion is denied; and it is further,

ORDERED that the application by the respondents Peter M. Redmond, Matthew M. Lupoli, and Peter M. Redmond, P.C., inter alia, to correct the designation of the parties contained in the Request for Appellate Division Intervention is dismissed without prejudice to making a motion for that relief; and it is further,

ORDERED that the application by the respondents Peter M. Redmond, Matthew M. Lupoli, and Peter M. Redmond, P.C., to serve and file a brief is granted and the time of those respondents to serve and file a brief is enlarged until July 11, 2013, and the brief of those respondents must be served and filed on or before that date; and it is further,

ORDERED that the application by the appellants is granted and the appellants' time to serve and file a reply brief is enlarged until July 26, 2013, and the appellants' reply brief must be served and filed on or before that date.
