ORDER


After making an independent review of the pleadings, files and records in this case, and the findings, conclusions and recommendation of the United States Magistrate Judge, filed on August 22, 2002, the court concludes that the findings and conclusions of the United States Magistrate Judge are correct. The findings, conclusions and recommendation of the United States Magistrate Judge are hereby accepted by the court. Petitioner's objections are overruled. Petitioner John Thomas Bagley's application for Writ of Mandamus is denied, because the court lacks jurisdiction to compel a state court to act by way of mandamus. Accordingly, Petitioner's application for mandamus is dismissed as frivolous pursuant to 28 U.S.C. § 1915A.
