Appellate Division of the Supreme Court of New York, Second Department
Jun 25, 1945
269 App. Div. 861 (N.Y. App. Div. 1945)

Opinion

June 25, 1945.

Order granting respondent's motion to confirm the report of an official referee, denying appellant's motion to direct the respondent to execute and deliver a satisfaction piece, etc., affirmed, with $10 costs and disbursements, on the ground that the evidence fails to establish, by a fair preponderance, that the judgment has been satisfied. Close, P.J., Hagarty, Johnston, Adel and Lewis, JJ., concur.
