This case was calendared for trial at the Court's Dallas, Texas trial session, which was scheduled to begin February 21, 2023. On January 27, 2023, respondent made a Motion to Dismiss for Lack of Prosecution. On January 30, 2023, the Court served an Order to Show Cause on petitioner instructing him to on or before February 17, 2023, show cause in writing why respondent's Motion to Dismiss for Lack of Prosecution filed January 27, 2023, should not be granted and a decision entered against petitioner for the amounts and year set forth in respondent's Motion. On February 21, 2023, this case was called and then recalled. There was no appearance by nor anyone on behalf of petitioner. Respondent's counsel appeared and was heard.

Upon due consideration and for cause more fully appearing in the transcript, it is hereby

ORDERED that respondent's Motion to Dismiss for Failure to Properly Prosecute filed January 23, 2023, is taken under advisement. It is further

ORDERED that the time within which petitioner shall respond to the Court's Order to Show Cause is extended to March 23, 2023. It is further

ORDERED that this case is continued. It is further

ORDERED that jurisdiction is retained by the undersigned.
