ORDER

Richard Hightower, Judge.

The Court abated this appeal by order issued August 16, 2022, to permit the parties to attempt to enforce a settlement agreement in federal court. By order issued on October 5, 2023, the Court continued the abatement, asking the parties to file status updates every 60 days. A status update was received in December 2023, but no further updates have been received.

The Court has learned that appellant filed a motion for rehearing in the Fifth Circuit case, which was denied and that mandate has issued. The Court requests updates from the parties within the next 10 days concerning finality or further action on the Fifth Circuit case, such as petition for certiorari in the United States Supreme Court.

It is so ORDERED.
