This matter is before the court because Appellant Michael A. Bacon has not timely filed both an opening brief and a motion for leave to proceed on appeal without prepayment of costs or fees.

Accordingly, this appeal is dismissed for failure to prosecute pursuant to Tenth Circuit Rules 3.3(B) and 42.1.

A copy of this order shall stand as and for the mandate of the court.
