The motion for substitution of party on death of defendant-appellee is GRANTED. The Clerk's Office is directed to amend the case caption to substitute the "Estate of Gregg E. Herman" for "Gregg E. Herman" and to list Cathy A. Herman as Personal Representative for the Estate of Gregg E. Herman.
