ORDER


Upon review of Joaquin Ayres Costa Rica's papers dated January 9, 2009, which purport to be a petition for writ of mandamus, it appears that the petition seeks supreme court review of Civil No. 03-1-0084. We lack jurisdiction to review Civil No. 03-1-0084. See HRS § 602-5 (Supp. 2007). Therefore,

IT IS HEREBY ORDERED that the clerk of the appellate court shall process the January 9, 2009 papers as a petition for writ of mandamus without payment of the filing fee.

IT IS FURTHER ORDERED that the petition for writ of mandamus is dismissed.
