Opinion

No. 624 2012.

2012-12-20

Jarreau AYERS, Defendant Below, Appellant, v. STATE of Delaware, Plaintiff Below, Appellee.

Court Below—Superior Court of the State of Delaware in and for New Castle County, Cr. ID Nos. 1106014092, 1012006345.

ORDER

RANDY J. HOLLAND, Justice.

This 20th day of December 2012, the Court has considered the Clerk's notice directing that the appellant, Jarreau Ayers, show cause why this appeal should not be dismissed for the Court's lack of jurisdiction to consider an appeal directly from a decision of a Commissioner of the Superior Court. Ayers' failure to respond to the notice to show cause is deemed to be his consent to the dismissal of this appeal.

The notice to show cause issued on November 27, 2012.

Ayers' response was due to be filed on or before December 10, 2012.

NOW, THEREFORE, IT IS ORDERED, pursuant to Supreme Court Rules 3(b)(2) and 29(b), that the appeal is DISMISSED.
