ALBERT AYALA, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 292nd Judicial District Court Dallas County, Texas
Trial Court Cause No. F14-70946-V

ORDER

Before the Court is appellant's April 24, 2017 third motion to extend time. When we granted appellant's second motion, we cautioned that the failure to file his brief by April 24 would result in the appeal being abated for a hearing. After reviewing appellant's motion and in the interest of expediting this appeal, we GRANT the motion and ORDER appellant's brief filed by May 26, 2017. The Court cautions that the failure to file the brief by that date will result in the case being abated for a hearing in accordance with rule 38.8, including whether new counsel should be appointed. See TEX. R. APP. P. 38.8.
