DECISION & ORDER ON MOTION
Motion by the respondent to vacate any automatic stay which is in effect pursuant to CPLR 5519 and to dismiss an appeal from an order and judgment (one paper) of the Supreme Court, Nassau County, entered June 21, 2012, on the ground that the appeal is frivolous and without merit.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
