Dov K. Avni v. Harris County Appraisal District

ORDER Trial court case number: 2016-65429 Trial court: 215th District Court of Harris County

Appellant's brief was originally due on March 1, 2017. Appellant filed two motions for extension, which this court granted until June 12, 2017, a date more than 100 days after the original due date. When we granted the second motion, we stated that no further extensions would be granted absent a showing of exceptional circumstances.

On June 14, 2017, appellee filed a motion to dismiss the appeal for want of prosecution. On the same date, appellant filed a motion that is styled as a second motion to extend time to file his brief, but the body of the motion does not request an extension. Rather, it states incorrectly that he complied with the "latest Court Clerk's notice to meet 6-12-17 filing deadline of my brief."

We deny appellant's motion. Appellant shall file his brief within 10 days of the date of this order or the appeal will be dismissed. See TEX. R. APP. P. 42.3.

It is so ORDERED. Judge's signature: /s/ Michael Massengale
