Appeal from the 419 District Court of Travis County, Texas (TC# D-1-GN-14-000743) ORDER
In his fourth motion for extension of time, Appellant alleges that the clerk's record is incomplete because numerous pages are missing from an exhibit attached to his first amended response to Appellee's motion for traditional and no-evidence summary judgment. On August 15, 2016, the Court directed the Travis County District Clerk's Office to determine whether the clerk's record filed with this Court comports with the record on file with the District Clerk. See TEX.R.APP.P. 34.5d). The District Clerk has informed the Court that the record on file comports with the record filed in this Court. As part of the investigation, the District Clerk asked Appellant to provide a file-marked copy of his summary judgment response for comparison with the response on file. Appellant did not comply with the District Clerk's request. Appellant has failed to show that the clerk's record is incomplete or inaccurate. Accordingly, we find that the clerk's record is complete. Appellant's fourth motion for extension of time is GRANTED until November 4, 2016. NO FURTHER MOTIONS FOR EXTENSION OF TIME TO FILE APPELLANT'S BRIEF WILL BE CONSIDERED BY THIS COURT.
It is further ORDERED that Armando Avila, pro se, prepare the Appellant's brief and forward the same to this Court on or before November 4, 2016.
