ORDER

This case is currently calendared on the Court's Baltimore, Maryland trial session, scheduled to begin April 8, 2024.

On March 13, 2024, the Commissioner filed a motion to dismiss for lack of prosecution. The Court will direct petitioner Marvin Baldemar Avila Estrada to file a response to the motion and appear at the above-referenced trial session to be heard on the motion. Accordingly, it is

ORDERED that, on or before April 1, 2024, Mr. Avila shall file a response to the motion to dismiss for lack of prosecution. It is further

ORDERED that the Commissioner's motion to dismiss for lack of prosecution is set for hearing at the calendar call of the Court's Baltimore, Maryland trial session, scheduled to begin at 10:00 a.m., on April 8, 2024, in Courtroom #9B, of the Edward A. Garmatz United States Courthouse, 101 West Lombard Street, Baltimore, Maryland 21201. If Mr. Avila fails to file a response to the motion or fails to appear at the hearing, the Court may grant the motion and enter a decision against him in the amounts set forth therein.
