This case is currently set for trial at the Court's December 11, 2023, Portland, Oregon trial session. On November 16, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution. Respondent's counsel advises that petitioner's counsel informed respondent that petitioner died subsequent to the filing of the petition in this case. Respondent's counsel has requested, but has not received, a death certificate or other information regarding the status of petitioner's estate. Upon due consideration and for cause, it is hereby

ORDERED that respondent's Motion is set for hearing at the Court's Portland, Oregon trial session, scheduled to commence on December 11, 2023, at 10:00 am at the Mark O. Hatfield U.S. Courthouse, 1000 SW Third Avenue, Courtroom 14B, Portland, Oregon 97204. It is further

ORDERED that, on or before the call of this case from the calendar, petitioner shall file a response to respondent's Motion to Dismiss for Lack of Prosecution.
