Opinion filed March 31, 1941.

SALES, § 261oil heating unit, breach of warranty. Judgment by confession was properly ordered to stand confirmed, where note constituted purchase price of an oil heating unit, and although defendants presented that the unit did not give sufficient heat, plaintiff's evidence and a letter written by defendant showed that excessive use of oil was the only thing complained of, and in instant action defendants did not contend that the oil used exceeded the estimate plaintiff had made.

Appeal from Municipal Court of Chicago; Hon. LEON EDELMAN, presiding. Affirmed.

Affirmed. Heard in first division, first district, this court at October term, 1940.
