Opinion

No. 87-2279.

November 16, 1988. Rehearing Denied December 12, 1988.

Appeal from the Circuit Court for Palm Beach County; Daniel T.K. Hurley, Judge.

Donald C. Dowling of Spinner, Dittman, Federspiel Dowling, Delray Beach, for appellant.

William Casey McIntyre of Alley, Maass, Rogers, Lindsay Chauncey, Palm Beach, for appellees — Joseph Greenwald and Champion Service, Inc.

Donald Freeman of Beverly Freeman, and Marjorie Gadarian Graham of Marjorie Gadarian Graham, P.A., West Palm Beach, for appellees — Budget Rental Car Sales, Budget Rent-A-Car Corp. and Budget Rent-A-Car Distributors.

AFFIRMED.

ANSTEAD and LETTS, JJ., concur.

WALDEN, J., dissents with opinion.

I respectfully dissent because, in my opinion, it manifestly appears that there are genuine issues of material fact which stand in the way of defendants being entitled to summary judgment as a matter of law. I would reverse the summary judgment and remand for a trial upon the merits.
