On order of the Court, the application for leave to appeal from the November 30, 1999, decision of the Court of Appeals and the application for leave to appeal as cross-appellant are considered, and it appearing to this Court that the case of Eversman v.Concrete Cutting Breaking (Docket No. 109977), is pending on appeal before this Court and that the decision in that case may resolve an issue raised in the present case, we ORDER that the application for leave to appeal and the application for leave to appeal as cross-appellant be held in ABEYANCE pending the decision in Eversman. The motion to consolidate this case with Eversman also is considered, it is DENIED.
