The petition for writ of certiorari reflected probable jurisdiction in this court so we issued the writ. However, after hearing argument and considering further the briefs and record we have determined that the writ was improvidently issued. Therefore the writ heretofore issued is discharged and the petition for writ of certiorari is dismissed.

It is so ordered.
