ORDER


Petitioner's application for a writ of habeas corpus is denied for the reasons stated in the thorough report and recommendation of Magistrate Judge Theodore H. Katz, to which no objection has been taken. For the same reasons, a certificate of appealability is denied, and the Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal herefrom would not be taken in good faith.

SO ORDERED.
