IT IS HEREBY ORDERED AND ADJUDGED that defendant Engineered Polymer Solutions's motion for summary judgment is granted. Plaintiffs cross motion for summary judgment is denied. The court incorporates as final the prior orders dismissing Count II and striking plaintiffs motion for summary judgment. This case is hereby dismissed in its entirety with prejudice.

All orders in this case are now final and appealable.
