Petitioner-appellant having moved (M-1324), and respondent-respondent-appellant having cross-moved (M-1963), for leave to appeal to this Court from the decision and order of the Appellate Term, First Department, entered in the office of the Clerk of the Supreme Court, New York County, on or about December 6, 2017,Now, upon reading and filing the papers with respect to the motion and cross motion, and due deliberation having been had thereon, It is ordered that the motion and cross motion are granted (M-1324/M-1963). Appellant and cross appellant shall file a copy of an informational statement, pursuant to section 1250.3(a) of the Practice Rules of the Appellate Division, and a copy of this order, with the Clerk of the Appellate Term, with proof of service, pursuant to 22 NYCRR 1250.14(f).
