Appeal from the Municipal Court of the City of New York, Borough of Manhattan, MARKS, J.

Max Grossberg and Costa N. Tesnakis for appellant.

The final order should be modified by adjudicating that the amount of rent due to the landlord is the sum of $70.25 and directing judgment for the landlord for the sum of $70.25, with costs, and, as modified, affirmed, with $10 costs. (See L. 1952, ch. 495, amdg. Civ. Prac. Act, § 1410, subd. 2.)

Appeal from order dismissed.

Ordered accordingly.
