ANIS ATTIA, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Courtney D. Jones Judge.

On June 10, 2024, respondent filed a Status Report (Doc. 21). The report states that "[i]n November of 2023, Settlement Officer Dodi Conlon informed respondent's counsel that she received a 1040x from petitioner for the 2015 tax year. She also informed respondent's counsel that she submitted the 1040x for the 2015 tax year for processing." On June 26, 2024, the Court ordered respondent to file a response informing the Court of (1) the cause for delay in processing petitioner's Form 1040x, and (2) when respondent anticipates the Form 1040x will be processed. (Doc. 22).

On July 9, 2024, respondent filed a Status Report (Doc. 23), informing the Court that processing of amended returns can take up to a year. Respondent also stated that SO Conlon "anticipate[s] the processing [of petitioner's amended return] to take at least another 60 days" since no service employee had been assigned to process the return. The Court notes that respondent did not inform the Court when he expects the Form 1040x to be processed.

Upon due consideration, it is

ORDERED that, on or before September 9, 2024, the parties shall file a status report (jointly if possible, otherwise separately) that provides the Court with an overview of the status of this case. If petitioner's Form 1040x has not been processed, respondent shall explain all efforts undertaken to process petitioner's Form 1040x.
