No. 05-06-01718-CV (Tex. App. Jul. 26, 2007)

Opinion

No. 05-06-01718-CV

Opinion filed July 26, 2007.

On Appeal from the 191st Judicial District Court Dallas County, Texas, Trial Court Cause No. 06-01894-J.

Before Justices WHITTINGTON, BRIDGES, and LANG-MIERS.

MEMORANDUM OPINION

On December 28, 2006, appellants filed a notice of appeal in this case. On the same day, we notified appellants by letter that the $125 filing fee was due. We gave appellants ten days to pay the filing fee, and we warned appellants that if they failed to comply with our directives within the time allowed, the appeal was subject to dismissal without further notice. Moreover, we have received a copy of the trial court's order sustaining the contest to appellants' affidavit of indigence. Nevertheless, to date, appellants have not paid the filing fee or otherwise communicated with the Court regarding this appeal.

Accordingly, on the Court's own motion, we DISMISS the appeal. See Tex. R. App. P. 5, 42.3(c); Appendix to the Tex. R. App. P. (B)(1)(a).
