STIPULATION AND ORDER RE DISMISSAL WITH PREJUDICE


IT IS HEREBY STIPULATED by and between plaintiff ATMEL CORPORATION and defendant CARGOLUX AIRLINES INTERNATIONAL, S.A. (hereinafter "Cargolux"), through their attorneys of record, that plaintiffs complaint against Cargolux be and hereby is dismissed with prejudice pursuant to Federal Rule of Civil Procedure 41(a)(1).

IT IS FURTHER STIPULATED THAT each party shall bear their own costs incurred in connection with the underlying action.

IT IS SO ORDERED.
