Counsel for the parties to this cause have filed a stipulation which we are treating as a confession of error. See 3 Fla.Jur.2d Appellate Review § 397. Accordingly, the order of summary final judgment entered by the trial court on October 4, 1978 is hereby reversed and the cause is remanded for further proceedings not inconsistent herewith.
