Opinion

No. 98-3425

Opinion filed June 2, 1999

Appeal from the Circuit Court for the Nineteenth Judicial Circuit, St. Lucie County; Cynthia G. Angelos, Judge, L.T. No. 96-2085 CF.

Richard L. Jorandby, Public Defender, and Bernard S. Fernandez, Assistant Public Defender, West Palm Beach, for appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Elaine L. Thompson, Assistant Attorney General, West Palm Beach, for appellee.

Affirmed. The order denying Stephen Ashley's rule 3.850 motion is affirmed. This court's affirmance is without prejudice to Ashley filing a properly executed petition for writ of habeas corpus in this court to seek a belated appeal. See Fla.R.App.P. 9.140(j).

POLEN, SHAHOOD and HAZOURI, JJ., concur.
