JAMES JOSEPH ASHBY, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the Criminal District Court No. 1 Dallas County, Texas
Trial Court Cause Nos. F06-01322-H, F06-68733-H

ORDER

The Court REINSTATES the appeals.

On October 27, 2015, we ordered the trial court to make findings regarding why the reporter's record had not been filed. On December 16, 2015, we received the reporter's record of the July 10, 2015 adjudication hearing. On January 7, 2016, we received a letter from court reporter Crystal Jones stating that a court reporter was waived for the 2008 original plea hearing. Accordingly, we conclude findings are no longer necessary and VACATE the October 27, 2015 order to the extent it requires findings.

We ORDER the reporter's record received on December 16, 2015 filed in both of these appeals as of the date of this order.

Appellant's brief is due within thirty days of the date of this order.
