At a pretrial conference on December 3, 2003, the Court informed counsel that if the plaintiff failed to amend the complaint within 10 days the case would be dismissed. Plaintiff has failed to file an amended complaint and accordingly the case is dismissed for lack of subject matter jurisdiction.
