On Appeal from the 152nd District Court Harris County, Texas
Trial Court Cause No. 2015-04657
ORDER
The reporter's record in this case was due January 23, 2017. See Tex. R. App. P. 35.1. On January 4, 2017, the court received notification from Cynthia Montalvo that they appellant has not made arrangements to pay for the record. On January 18, 2017 the court received proof of payment for the record and extended the record due date to February 17, 2017. On January 30, 2017 and March 16, 2017 motions for extension of time were filed and granted to April 14, 2017 with the notation that no further extensions will be granted absent exceptional circumstances. The court received another motion for extension of time to file the record on April 18, 2017, which was granted to May 1, 2017 with the notation no further extensions. The court has not received a request to extend time for filing the record. The record has not been filed with the court. Because the reporter's record has not been filed timely, we issue the following order.
We order Cynthia Montalvo, the official court reporter, to file the record in this appeal within 30 days of the date of this order. No further extension will be entertained. The trial and appellate courts are jointly responsible for ensuring that the appellate record is timely filed. See Tex. R. App. P. 35.3(c). If Cynthia Montalvo does not timely file the record as ordered, we may issue an order directing the trial court to conduct a hearing to determine the reason for the failure to file the record.
