ORDER

The Court's Order, filed November 12, 2002, is hereby VACATED. Under Rule 6(a) of the Federal Rules of Civil Procedure, "Plaintiffs' Objections to Findings, Conclusions, and Recommendation of the United States Magistrate Judge," filed November 7, 2002, were timely filed. Plaintiffs' Objections have now been thoroughly considered and are hereby OVERRULED.

After making an independent review of the pleadings, files, and records in this case and the Findings, Conclusions, and Recommendation of the United States Magistrate Judge, I am of the opinion that the Findings and Conclusions of the Magistrate Judge are correct and they are adopted as the Findings and Conclusions of the Court. Accordingly, "Plaintiff's Motion to Remand for Lack of Subject Matter Jurisdiction," filed May 22, 2002, is DENIED.
