Appellant's brief is overdue. Appellant's brief was originally due December 1, 2023. On December 4, 2023, this Court notified appellant's counsel, Mark Watson, that appellant's brief was overdue and directed him to file appellant's brief and a motion for extension of time to file the brief within ten days. As of the date of this order, neither appellant's brief nor a motion for extension of time to file the brief have been filed, and Mr. Watson has not communicated with this Court concerning this appeal.

We ORDER Mr. Watson to file appellant's brief and motion for extension of time to file the brief on or before JANUARY 16, 2024. If appellant's brief and a motion for extension of time to file the brief are not filed by that date, this appeal may be abated for the trial court to make findings in accordance with Rule of Appellate Procedure 38.8. See TEX. R. APP. P. 38.8(b)(2).
