Ricardo ARREOLA, Jr., Appellant v. The STATE of Texas, Appellee

From the 81st Judicial District Court, Atascosa County, Texas Trial Court No. 20-05-0097-CRA Honorable Walden Shelton, Judge Presiding

ORDER

Patricia O. Alvarez, Justice

Appellant's brief was originally due on March 11, 2022. After no brief was filed, we ordered Appellant's attorney to file the brief or a motion to dismiss by April 25, 2022. Counsel did not file the brief as ordered, and he did not file a motion to dismiss.

On May 6, 2022, we abated this appeal and remanded the cause to the trial court for an abandonment hearing-with specific questions for the trial court to address. On June 7, 2022, the court reporter filed a supplemental reporter's record and the trial court filed its findings of fact and conclusions of law. It found that Appellant wants to maintain his appeal. It also found that, due to Appellant's counsel's current health concerns, new appellate counsel should be appointed.

We reinstate this appeal. We order Appellant's newly appointed counsel to file Appellant's brief within thirty days of the date of this order.

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 10th day of June, 2022.
