Appeal from an order of the Supreme Court, Onondaga County (Scott J. DelConte, J.), entered April 29, 2021. The order denied the motion of defendant E. I. du Pont de Nemours and Company for summary judgment.

Now, upon reading and filing the stipulation of discontinuance signed by the attorneys for the parties on January 12, 2023, It is hereby ORDERED that said appeal is unanimously dismissed without costs upon stipulation.
