Mark Aronoff v. Ruth Aronoff

LC No. 21-000879-DO

Jane E. Markey Presiding Judge Douglas B. Shapiro Kathleen A. Feeney Judges

ORDER

On the Court's own motion, MCR 7.216(A)(7), appellant's March 6, 2023 brief on appeal is STRICKEN. The February 8, 2023 order appealed from was final and appealable by right as a postjudgment order awarding attorney fees, MCR 7.203(A)(1); MCR 7.202(6)(a)(iv), and the appeal is limited to the issue of attorney fees, MCR 7.203(A)(1). The issues raised in the March 6, 2023 brief on appeal are outside the scope of this Court's jurisdiction. Within 21 days of the Clerk's certification of this order, appellant may file a new brief on appeal, raising issues within the scope of the appeal. Appellee may file a responsive brief within 21 days of proof of service of appellant's new brief. Appellant's failure to file a brief in accordance with this order may result in the involuntary dismissal of this appeal without further notice to the parties. Entry of this order is without prejudice to appellant filing a late appeal under MCR 7.205(A)(4) as to the non-attorney fee portions of the February 8, 2023 order, provided such a filing meets all requirements under the court rules and is not time-barred.
