Motion to dismiss a portion of the appeal herein granted and the appeal dismissed, without costs, insofar as it seeks to review the order of the Appellate Division denying plaintiff-appellant's motion for reargument, upon the ground that it involves a question of discretion of the type not reviewable by the Court of Appeals (Cohen and Karger, Powers of the New York Court of Appeals, § 147, p 585).

Motion, insofar as it seeks an order rejecting any papers contained in the proposed record on appeal which pertain to the April 13, 1978 order of the Appellate Division, dismissed as premature.
