Order
On order of the Court, the application for leave to appeal the January 19, 2023 judgment of the Court of Appeals is considered. We direct the Clerk to schedule oral argument on the application. MCR 7.305(H)(1). The parties shall file supplemental briefs in accordance with MCR 7.312(E), addressing whether: (1) under Administrative Order 2020-3 and Administrative Order 2020-18, the pre-suit notice period described in MCL 600.2912b continued to run from March 10, 2020 to June 20, 2020; and (2) whether the Court of Appeals correctly held that the plaintiff's complaint was not timely filed. The total time allowed for oral argument shall be 40 minutes: 20 minutes for the appellant, and 20 minutes for the appellees, to be divided at their discretion. MCR 7.314(B)(2).
We further direct the Clerk to schedule the oral argument in this case for the same future session of the Court when it will hear oral argument in Carter v DTN Mgt Co (Docket No. 165425).
The Michigan Association for Justice, Michigan Defense Trial Counsel, Inc., and the Negligence Law Section of the State Bar of Michigan are invited to file briefs amicus curiae. Other persons or groups interested in the determination of the issues presented in this case may move the Court for permission to file briefs amicus curiae.
