DECISION & ORDER ON MOTION

Motion by the appellant to stay enforcement of stated portions of a judgment of the Supreme Court, Nassau County, entered June 24, 2011, pending hearing and determination of an appeal therefrom.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted to the extent that enforcement of so much of the judgment entered June 24, 2011, as directed the appellant to maintain life insurance in the sum of $5,000,000 is stayed pending hearing and determination of the appeal on condition that the appellant maintain and continue the currently existing life insurance policies, and the motion is otherwise denied; and it is further,

ORDERED that in the event the appellant does not comply with the foregoing condition, the Court, on its own motion, may vacate the stay, or the respondent may move to vacate the stay, on three days notice.
