9:02 a.m. This is the time set for a Rule 16 Scheduling Conference. Plaintiffs are represented by counsel, Paul Mooney. Defendant, Yavapai County is represented by counsel, Roberta Livesay. Defendant Arizona Department of Revenue is represented by counsel, Jerry Fries.
A record of the proceedings is made by audio and/or videotape in lieu of a court reporter.
The status of discovery and the parties' competing Pretrial Memoranda are discussed.
Counsel are instructed to meet by May 10, 2013 with the necessary documents and attempt to accomplish the following: 1.) Resolve the protective order issues and prepare to exchange their experts' files; 2.) Determine which of the Plaintiffs' leases have been produced and which ones remain to be obtained; and 3.) Schedule the depositions of the experts. During the meeting, counsel shall identify which leases are missing and cooperate in determining the most expeditious way to produce them. If there is a problem in obtaining the remaining leases, counsel may either file a motion or, if the Court is available, call in for a conference. At this time, the discovery should focus on the valuation and not the classification issue.
IT IS ORDERED counsel shall file a brief joint report indicating what was accomplished at the meeting by May 15, 2013.
IT IS FURTHER ORDERED the competing Scheduling Orders are taken under advisement.

Arizona Tax Court - ATTENTION: eFiling Notice
Beginning September 29, 2011, the Clerk of the Superior Court will be accepting post-initiation electronic filings in the tax (TX) case type. eFiling will be available only to TX cases at this time and is optional. The current paper filing method remains available. All ST cases mu continue to be filed on paper. Tax cases must be initiated using the traditional paper filing method. Once the case has been initiated and assigned a TX case number, subsequent filings ca be submitted electronically through the Clerk's eFiling Online website at http://www.clerkofcourt.maricopa.gov/
NOTE: Counsel who choose eFiling are strongly encouraged to upload and e-file all proposed orders in Word format to allow for possible modifications by the Court. Orders submitted in .pdf format cannot be easily modified and may result in a delay in ruling.
