Motion by the named defendant for taxation of costs and attorney's fees incurred in a prior action in which the plaintiff was nonsuited, brought to the Superior Court in the judicial district of Hartford-New Britain at New Britain and tried to the court, Higgins, J.; judgment awarding costs and attorney's fees to the named defendant, from which the plaintiff appealed to this court. No error.
