Appeal from 143rd District Court of Reeves County, Texas (TC # 15-03-20950-CVR) MEMORANDUM OPINION
Pending before the Court is a joint motion to reverse and remand as authorized by TEX.R.APP.P. 42.1(a)(2)(B). The motion is granted. Accordingly, we reverse the trial court's summary judgment without regard to the merits and remand the cause to the trial court for further proceedings. In accordance with the parties' agreement, costs are taxed against the party incurring them. See TEX.R.APP.P. 42.1(d). April 6, 2016
