MATTER OF A.R., PETITIONER-RESPONDENT, v. P.C., RESPONDENT-APPELLANT.


PRESENT: , P.J., PERADOTTO, LINDLEY, SCONIERS, AND MARTOCHE, JJ.

Respondent-appellant having moved for an extension of time to perfect the appeal taken herein from an order of the Family Court, Erie County, entered in the Office of the Clerk of said Court on April 14, 2010, and to amend the caption of the case,

Now, upon reading and filing the affidavit of A.L. Beth O'Connor, Esq., sworn to July 1, 2011, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks an extension of time to perfect is granted and respondent-appellant shall file the original and ten copies of the stipulated or settled record and ten briefs on the appeal, together with proof of service, on or before October 3, 2011, and in the event of failure to so perfect the appeal is hereby dismissed without further order, and

It is further ORDERED that the motion insofar as it seeks to amend the caption is granted and the caption shall be amended to read "A.R., petitioner-respondent v P.C., respondent-appellant".

Memorandum: No further extensions will be granted.
