Appelhof v. Appelhof

District Court of Appeal of Florida, Second District
Apr 10, 1984
448 So. 2d 533 (Fla. Dist. Ct. App. 1984)

Opinion

No. 83-967.

March 9, 1984. Rehearing Denied April 10, 1984.

Appeal from Circuit Court, Pinellas County; Charles M. Phillips, Jr., Judge.

N. David Korones, Clearwater, for appellant.

Joseph R. Park of Park Smith, Clearwater, for appellee.

The trial court denied the motion of a noncustodial ex-wife for a temporary restraining order to prevent the custodial ex-husband from removing children of the marriage from Florida to the ex-husband's new residence in another state. Under the facts of this case we do not find an abuse of discretion by the trial court. See Canakaris v. Canakaris, 382 So.2d 1197 (Fla. 1980).

AFFIRMED.

OTT, C.J., and CAMPBELL, J., concur.
