DECISION AND ORDER ON MOTION

Motion to dismiss appeal.

Upon the papers filed in support of the motion, and the papers filed in opposition thereto, it is

ORDERED that the motion is denied, without costs, and without prejudice to the issue involved being raised upon argument of the appeal. Respondent shall, by personal service or overnight mail service, on or before December 4, 2015, file a supplemental responding brief containing arguments solely as to why the appeal should be dismissed. Appellant shall, by personal service or overnight mail service, on or before December 18, 2015, file a supplemental reply brief in response solely to the arguments raised by respondent in its supplemental brief.
