In the Matter of the Application of Daniel Nii Yartey Annan, Petitioner-Appellant, For a Judgment Pursuant to Article 78of the CPLR, v. New York State Department of Motor Vehicles, Respondent-Respondent.


An appeal having transferred to this Court pursuant to CPLR 7804(g) by from the order of the Supreme Court, New York County, entered on or about July 20, 2017, And petitioner-appellant having moved for leave to prosecute the aforesaid appeal as a poor person, and for a stay of an administrative order pending hearing and determination of said appeal, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied, and the interim relief granted by an order of a Justice of this Court, entered September 21, 2017, is vacated.
