447 So. 2d 1003 (Fla. Dist. Ct. App. 1984)

Opinion

No. 82-1632.

March 28, 1984.

Appeal from Circuit Court, Palm Beach County; Don T. Adams, Judge.

Richard L. Jorandby, Public Defender, and Tatjana Ostapoff and Lee Kretschmer, Asst. Public Defenders, West Palm Beach, for appellant.

Jim Smith, Atty. Gen., Tallahassee, and Marlyn J. Altman, Asst. Atty. Gen., West Palm Beach, for appellee.

We reverse appellant's conviction and remand for a new trial because it does not appear that appellant, in writing, waived a jury trial with the consent of the State. Williams v. State, 440 So.2d 1290 (Fla. 4th DCA, 1983).

Reversed and remanded for new trial.

HURLEY, DELL and WALDEN, JJ., concur.
