DECISION & ORDER ON MOTION

Appeal from a final judgment of the District Court of Nassau County, First District, entered March 24, 2014. The final judgment awarded respondent possession in a holdover summary proceeding. By letter dated October 28, 2015, appellant's attorney advised this court that appellant had vacated the premises, and counsel consented to the dismissal of the appeal as moot.

Now, upon the court's own motion, and upon the letter dated October 28, 2015 from appellant's attorney consenting to the dismissal of the appeal, it is

ORDERED that the appeal is dismissed as moot.
