Anechiarico v. Thompson

District Court of Appeal of Florida, Fourth District
Feb 6, 1991
573 So. 2d 453 (Fla. Dist. Ct. App. 1991)

Opinion

No. 90-2884.

February 6, 1991.

Appeal of a non-final order from the Circuit Court for Palm Beach County; Hubert R. Lindsey, Judge.

William Anechiarico, Belle Glade, pro se.

No appearance for appellee.

We reverse the order as the proposed, unconsidered amended complaint seeks a determination of parental responsibility, not paternity.

We remand with direction to consider: (1) the plaintiff's motion to amend his complaint; (2) the effect of his incarceration upon his entitlement to relief; (3) any further jurisdictional issues; and (4) if jurisdiction lies, the best interests of the child.

HERSEY, C.J., and ANSTEAD and GLICKSTEIN, JJ., concur.
