Appellant Custom Crews, Inc. having moved for an extension of time to perfect the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Erie on April 18, 2012,

Now, upon reading and filing the affirmation of Thomas P. Kawalec, Esq., dated December 26, 2012, the notice of motion with proof of service thereof, and the affidavit of William D. Christ, Esq., sworn to January 14, 2013, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted on the condition that appellant Custom Crews, Inc. perfects its appeal on or before February 27, 2013.
